CMPLT Health and Tech Private Limited, operating under the name Ferteve (“us”, “we”, or “Ferteve”, which includes its affiliates), is the creator, owner, and publisher of the online platform https://ferteve.in (“Website”). This includes all software, services, and applications provided by Ferteve, including but not limited to the mobile application Ferteve, and the software, services, and applications offered under the brand names ‘Ferteve’ (collectively referred to as the “Services”).

This Privacy Policy (“Privacy Policy”) outlines the manner in which we collect, use, share, disclose, and protect personal information of Users accessing or utilizing the Services, including Practitioners (as defined in the Terms of Use available at https://ferteve.in), User (as defined in the Terms of Use), and visitors to the Website (collectively referred to as “you” or “Users” in this Privacy Policy). This Privacy Policy is designed to illustrate our commitment to safeguarding your privacy and the confidentiality of your personal information. Your access to and use of the Services is governed by this Privacy Policy and our Terms of Use. Any capitalized terms used herein but not otherwise defined shall bear the meaning ascribed to them in the Terms of Use.

BY USING THE SERVICES OR BY OTHERWISE PROVIDING US WITH YOUR INFORMATION, YOU WILL BE DEEMED TO HAVE READ, UNDERSTOOD, AND AGREED TO THE PRACTICES AND POLICIES OUTLINED IN THIS PRIVACY POLICY, AND YOU AGREE TO BE BOUND BY ITS TERMS. YOU HEREBY CONSENT TO OUR COLLECTION, USE, SHARING, AND DISCLOSURE OF YOUR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY. WE RESERVE THE RIGHT TO CHANGE, MODIFY, ADD, OR DELETE PORTIONS OF THE TERMS OF THIS PRIVACY POLICY AT OUR SOLE DISCRETION AT ANY TIME. IF YOU DO NOT AGREE WITH THIS PRIVACY POLICY AT ANY TIME, DO NOT USE ANY OF THE SERVICES OR PROVIDE US WITH YOUR INFORMATION. IF YOU USE THE SERVICES ON BEHALF OF ANOTHER INDIVIDUAL OR ENTITY (SUCH AS YOUR EMPLOYER), YOU REPRESENT THAT YOU ARE AUTHORIZED TO (I) ACCEPT THIS PRIVACY POLICY ON THEIR BEHALF, AND (II) CONSENT ON BEHALF OF THAT INDIVIDUAL OR ENTITY TO OUR COLLECTION, USE, AND DISCLOSURE OF THEIR INFORMATION AS DESCRIBED IN THIS PRIVACY POLICY.

1. PURPOSE OF THIS PRIVACY POLICY
This Privacy Policy is published in compliance with, inter alia:

  • Section 43A of the Information Technology Act, 2000;

  • Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (“SPI Rules”);

  • Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

This Privacy Policy outlines the following:

  • The types of information collected from Users, including Personal Information (as defined in Paragraph 2 below) and Sensitive Personal Data or Information (as defined in Paragraph 2 below) relating to an individual;

  • The purposes, methods, and modes of collection, usage, processing, retention, and destruction of such information; and

  • The manner and the parties to whom Ferteve will disclose such information.

2. COLLECTION OF PERSONAL INFORMATION

In order to effectively provide our Services, it is essential for us to collect certain personal information about you. This information enables us to tailor our offerings to meet your specific needs. By accessing or using our Services, or by engaging with us through various channels such as emails, telephone calls, or other forms of communication, you consent to the voluntary collection of personal information. Such information may include, but is not limited to, the following:

  1. Contact Information
    Information such as your email address, phone number, and other relevant contact data.

  2. Demographic Information
    Information regarding your gender, date of birth, postal address, and pin code.

  3. Usage Data
    Information related to your use of the Services, including the history of appointments made by or with you through the platform.

  4. Insurance Information
    Details about your insurance coverage, including the name of your insurance provider and plan details.

  5. Voluntary Information
    Any other information you voluntarily provide to us, such as details shared through emails, letters, questionnaires, surveys, events, calls, or any other form of correspondence or required interaction. This may include images, documents, files, or any other relevant materials.

  6. Practitioner Data
    Information shared by Practitioners regarding the treatment or services availed by you. The information collected from you by us may fall under the category of "personal information" or "sensitive personal data or information" as defined under the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPI Rules").

  7. Personal Information                                                                                             Under the SPI Rules, "Personal Information" refers to any information related to an individual, which, either directly or indirectly, in combination with other information available or likely to be available, can identify that person.

  8. Sensitive Personal Data or Information                                                        "Sensitive Personal Data or Information" is defined under the SPI Rules as personal information that pertains to the following:

  • Passwords;

  • Financial information (e.g., bank account, credit and debit card details, or any other payment information);

  • Physical, physiological, and mental health condition;

  • Sexual orientation;

  • Medical records and history;

  • Biometric information;

  • Information received by a body corporate under a lawful contract or otherwise;

  • Visitor details provided at the time of registration or thereafter; and

  • Call data records.

It should be noted that we are entitled to collect, use, and disclose information that is freely available in the public domain without requiring your explicit consent.

3. PRIVACY STATEMENTS

3.1 FOR ALL USERS:

This section applies to all users of the Services.

3.1.1
The use of and access to the Services by each User is conditional upon their acceptance of the Terms of Use, which also incorporates acceptance of this Privacy Policy. Users who do not agree to any of the terms contained in the Terms of Use or this Privacy Policy must discontinue the use of the Services provided by Ferteve immediately.

An indicative list of the types of information that Ferteve may require you to provide for enabling your use of the Services is set out in the Schedule I annexed to this Privacy Policy.

All information provided to Ferteve by Users, including Personal Information or any Sensitive Personal Data or Information, is given voluntarily. Users understand and agree that Ferteve may use their information, which is designated as Personal Information or Sensitive Personal Data or Information under the SPI Rules, for the following purposes:

  • (a) Provision of the Services, including but not limited to creating smart reports, formulating inferences, and providing health suggestions based on the data and information you share with us.;

  • (b) Commercial purposes, in an aggregated or non-personally identifiable form, for research, statistical analysis, and business intelligence purposes;

  • (c) Sale or transfer of research, statistical or business intelligence data in aggregated or non-personally identifiable form to third parties and affiliates;

  • (d) Communication purposes, including for booking appointments and obtaining feedback regarding Practitioners;

  • (e) Debugging customer support-related issues;

  • (f) Contacting you to complete a transaction if you fail to do so after providing contact information.

Ferteve reserves the right to use information provided by End-Users for the following purposes:

  • Identifying the End-User, including to conduct statistical studies, build predictive models, publish research or findings, and derive statistical representations based on the data provided.;

  • Publishing information on the Website;

  • Contacting End-Users to offer new products or services;

  • Collecting feedback on products and services;

  • Analyzing software usage patterns to improve product design;

  • Commercial analysis of anonymized practice information;

  • Processing payment instructions through third-party providers such as payment gateways, banking institutions, and pre-paid instrument or wallet providers.

If you voluntarily provide your Personal Information to Ferteve for the purposes mentioned above, you hereby consent to such collection and use by Ferteve. Ferteve may contact you on any telephone number(s), including those registered under the Do Not Call (DNC) registry, provided we have obtained your express written consent to do so by your agreement to this Privacy Policy.

3.1.4
The collection, use, and disclosure of Personal Information or Sensitive Personal Data or Information as defined under the SPI Rules requires express consent from the User. By agreeing to this Privacy Policy, you provide consent for such collection, use, and disclosure as required by law.

3.1.5
Ferteve does not endorse or control any content, messages, or information found in the Services and disclaims all liability arising from participation in such services. You agree to waive any claims against Ferteve regarding such content, and where such waiver is ineffective, you agree to release Ferteve from any claims relating to the same.

3.1.6
You are responsible for ensuring the accuracy of the information you provide. Should your Personal Information change, you may correct, delete, or amend such information via the member information page or by contacting us at info@ferteve.in. Ferteve may refuse to correct or delete Personal Data where it is opinion data kept for evaluative purposes or part of a prosecution record, unless all proceedings have been completed.

3.1.7
If you wish to cancel your account or stop the use of your information for the provision of Services, you may contact us at info@ferteve.in. Ferteve will retain your information for as long as your account is active or as necessary to provide the Services, after which the data may be anonymized and used for analytic purposes. Withdrawal of consent or cancellation of your account may prevent Ferteve from providing certain services.

To opt-out of non-essential communications such as promotional and marketing-related messages, you may contact us at info@ferteve.in.

3.1.9
Ferteve may require payment via credit card, UPI, net banking, wire transfer, debit card, or cheque for subscription-based services. Ferteve will use and disclose such payment information, including credit card details, as necessary to process payments securely through third-party providers. Ferteve advises Users to exercise caution when using the internet for such purposes.

3.1.10
As per internet standards, Ferteve automatically receives certain information when Users or visitors access the Website, including the URL of the previous site, IP address, operating system, browser type, and other related information. Ferteve may use this information for trend analysis and improvement of its Services.

3.1.11
The Website uses temporary cookies for administrative purposes. Third-party cookies may be placed or recognized by authorized parties, but they do not store any Personal Information. Users may disable cookies via their browser settings; however, this will significantly limit the functionality of the Website and may affect your overall user experience.

Users may access limited features of the Website without registration. Full access requires account creation, which involves providing Personal Information such as name, email, phone number, and financial details.

3.2 Practitioners' Privacy Notice:

This section applies to all Practitioners.

3.2.1 As part of the registration process, as well as the application creation and submission process available to Practitioners on Ferteve, certain information, including Personal Information and Sensitive Personal Data or Information, is collected from Practitioners.

3.2.2 All statements in this Privacy Policy are applicable to all Practitioners. Practitioners are required to carefully review and understand these statements before submitting any Personal Information or Sensitive Personal Data or Information to Ferteve. Practitioners who do not agree with any provisions of this Privacy Policy must immediately cease using the Services, including the Website.

3.2.3 Any personally identifiable information provided by Practitioners to Ferteve is used to assist in identifying and describing them. This information is owned by Ferteve, and by providing such information, Practitioners consent to Ferteve’s collection, use, processing, and disclosure of the information for the purposes outlined herein. Ferteve may use this information for commercial purposes, as well as in aggregated or non-personally identifiable forms for research, statistical analysis, and business intelligence purposes. Ferteve may also sell or transfer such aggregated data to third parties and affiliates. Additionally, Ferteve reserves the right to use information provided by or about Practitioners for the following purposes:

  • Publishing such information on the Website;

  • Contacting Practitioners regarding new products or services, subject to compliance with applicable "Do Not Call" registry laws;

  • Gathering product feedback from Practitioners;

  • Analysing software usage patterns for the purpose of improving product design and utility;

  • Analysing anonymized practice information, including financial and inventory data, for commercial purposes.

3.2.4 Ferteve automatically enables the listing of Practitioners’ information on its Website for every “Doctor”,“Clinic”, “Nutritionist”, “Fitness Specialist” or “Mental Health Specialist” added to a practice through the software. This information is displayed when End-Users search for doctors on the Website and may be used by End-Users to request appointments. The information listed is provided by Practitioners or collected from the public domain and displayed on an "as-is" basis, without any warranty or representation regarding its accuracy or completeness. Practitioners are strongly encouraged to verify the accuracy of their information and promptly inform Ferteve of any discrepancies or changes. Ferteve will take reasonable steps to ensure the accuracy of this information.

3.2.5 Ferteve may display information for Practitioners who have not signed up or registered for the Services, provided that the Practitioners have given their consent for Ferteve to collect, process, and/or disclose their information on the Website. While Ferteve makes reasonable efforts to ensure the accuracy of such information, it does not assume liability for any incorrect or incomplete information displayed for these Practitioners.


3.3 End-Users' Privacy Notice:

This section applies to all End-Users.

3.3.1 During the registration and application creation process available to End-Users on the Website, certain Personal Information and Sensitive Personal Data or Information is collected from End-Users.

3.3.2 All End-Users must carefully read and understand the statements contained in this Privacy Policy before submitting any Personal Information or Sensitive Personal Data or Information to Ferteve. If an End-User does not agree with the terms of this Privacy Policy, they must immediately cease using the Services and the Website.

3.3.3 If an End-User has inadvertently submitted any information to Ferteve without reviewing the Privacy Policy and disagrees with the way in which their information is collected, processed, stored, used, or disclosed, they may access, modify, or delete their information using the options provided on the Website. Additionally, End-Users may inquire if Ferteve holds any of their personal data and may request its deletion or destruction by sending an email to info@ferteve.in.

3.3.4 Personal information provided by End-Users on the Website is used to help describe and identify them. Any other non-personally identifiable information collected by Ferteve is used exclusively for its purposes. Ferteve may use this information in an aggregated or non-personally identifiable form for research, statistical analysis, business intelligence purposes, and may transfer or sell such data to third parties and affiliates. Specifically, Ferteve reserves the right to use anonymized demographic and health information for:

  • Analysing software usage patterns to improve product design and utility;

  • Developing new technologies through research and analysis;

  • Incorporating the results of this analysis into other commercial product offerings by Ferteve;

  • Sharing this information with third parties for commercial purposes.

3.3.5 Ferteve may communicate with End-Users via email, phone, notices posted on the Website, or other communication means available through the Services. End-Users may change their communication preferences by adjusting the settings in their accounts on the Website.

3.3.6 Ferteve may occasionally conduct user surveys to collect preferences and feedback. Participation in these surveys is optional, and responses will be kept anonymous. Similarly, End-Users may participate in contests where contact and demographic information is requested. Demographic information collected during the registration process and through surveys helps Ferteve improve its Services to better meet the needs of End-Users.

3.3.7 End-Users who avail Services from Practitioners or clinical establishments consent to sharing their treatment-related data, including medical records, with Ferteve for the limited purpose of effectively providing Services.

3.3.8 Ferteve may maintain records of electronic communications and telephone calls made or received for the purpose of appointment management, customer support, research and development, and improving the listing of Practitioners.

3.3.9 All Ferteve employees and data processors who handle sensitive personal data or information are obligated to respect the confidentiality of such data. Ferteve has implemented appropriate technical and organizational measures to maintain the security of personal data from collection to destruction. Any third-party data processors to which Ferteve transfers personal data are required to comply with these procedures or implement equivalent measures.

3.3.10 Ferteve may disclose or transfer End-Users' personal and other information to a third party in the event of a reorganization or sale of Ferteve’s assets. Any third party acquiring such assets will have the right to continue using End-Users' personal and other information in accordance with the Terms of Use.

3.3.11 To the extent necessary for providing Services, Ferteve may share End-Users' personal information with third-party contractors who assist in service delivery, communication, or Website maintenance. These contractors may access information as needed to perform their tasks but may not use it for other purposes. Third-party service providers, including providers of online communications services, may use and disclose personal information in accordance with their privacy policies, and by using the Website, End-Users consent to this disclosure.

3.4 Casual Visitors Notice:

3.4.1 Ferteve does not automatically collect any sensitive personal data or information from casual visitors who are merely browsing the Website.

3.4.2 However, certain provisions of this Privacy Policy apply to casual visitors, and they are required to read and understand the privacy statements contained herein. If casual visitors do not agree with the terms of this Privacy Policy, they are required to leave the Website immediately.

3.4.3 If you, as a casual visitor, have inadvertently browsed any page of the Website prior to reading this Privacy Policy and do not agree with the collection, processing, storage, use, disclosure, or retention of information as described, you may clear temporary cookies installed by Ferteve by closing your browser. However, Ferteve recommends using the "clear cookies" functionality of your browser, as it cannot guarantee or predict the behaviour of all users' devices.

3.4.4 You are not considered a casual visitor if you have voluntarily submitted any personal data or information to Ferteve through any means, including but not limited to email, postal communication, or through the registration process on the Website. In such cases, you will be considered a User for the purposes of this Privacy Policy, and all the provisions contained herein shall apply to you.

4. Confidentiality and Security:

4.1 Ferteve maintains your Personal Information in electronic form on its systems and on the systems of its employees. This information may also be converted to physical form periodically. Ferteve takes all necessary precautions to protect your personal information, both online and offline, by implementing reasonable security practices and measures, including managerial, technical, operational, and physical security controls, commensurate with the nature of the information collected and the scope of Ferteve’s business.

4.2 Ferteve's administrators do not have access to your password. It is your responsibility to protect your password and prevent unauthorized access to your account, computer, and mobile device. You must log out from the Website after each session. Ferteve assumes no liability for unauthorized use of your account and password. If you suspect any unauthorized use of your account, you must immediately notify Ferteve by sending an email to info@ferteve.in. You shall be liable to indemnify Ferteve for any loss suffered due to unauthorized use of your account and password.

4.3 Ferteve makes User information accessible to its employees, agents, partners, and third parties on a need-to-know basis only, and binds its employees to strict confidentiality obligations.

4.4 A core function of Ferteve is to assist doctors in maintaining and organizing patient information. As a result, Ferteve may retain and submit such records to relevant authorities or to doctors who request access to such information, in accordance with applicable law.

4.5 Another function of Ferteve is to assist patients in accessing information related to their medical records. Therefore, Ferteve may retain and provide such records to patients or their doctors upon request.

4.6 Notwithstanding the above, Ferteve is not responsible for the confidentiality, security, or dissemination of your Personal Information by partners or third parties beyond the scope of Ferteve’s agreements with those partners and third parties. Ferteve is also not liable for any security breaches or actions by third parties or events beyond its reasonable control, including but not limited to acts of government, hacking, unauthorized access to data storage devices, system crashes, security breaches, encryption failures, or poor-quality internet or telephone service used by the User.

5. Changes to Privacy Policy

Ferteve reserves the right to update, modify, or amend this Privacy Policy at any time, with or without prior notice. In the event of significant changes to the manner in which Ferteve handles Users' personally identifiable information or substantial modifications to the Privacy Policy, Ferteve will provide a notification either through a visible notice on the Website or via email communication, as previously outlined, to allow Users the opportunity to review the amended terms before continuing to use the Services.

If a User disagrees with any of the changes and chooses to discontinue using the Services, they may contact Ferteve at info@ferteve.in to request the deactivation of their account. Unless otherwise specified, the current version of the Privacy Policy will apply to all information that Ferteve holds about the User and their account.

By continuing to access the Website or use the Services after a notice of changes has been sent or posted on the Website, the User hereby provides their explicit consent to the revised terms of this Privacy Policy.

6. Children's and Minors' Privacy

Ferteve does not permit anyone under the age of 18 to use its Website or Services. We strongly advise parents and guardians to ensure that minors do not access or use the Website or mobile application. Ferteve is committed to preventing the collection of personal information from individuals under 18 and encourages the use of parental control tools to monitor and restrict minors' online activities. 

6.1 Collection of Minors' Information
Our services are not intended for individuals under the age of 18. Should we become aware that we have inadvertently collected personal information from a minor, we will take immediate steps to delete such information in accordance with applicable legal standards. Furthermore, we shall not be held responsible for any other violations or misuse of our services that may occur as a result of a minor falsely providing personal information, as we do not knowingly or intentionally serve individuals under the age of 18.

By accessing and using the Website and its Services, you acknowledge that this Privacy Policy forms part of the Website's Terms of Use, and you unconditionally agree to the following:

(i) Your acceptance of the terms outlined in this Privacy Policy; and
(ii) Your consent to Ferteve’s collection, use, processing, and/or disclosure of your Personal Information as set forth in this Privacy Policy.

Your continued use of the Website and Services is subject to your acceptance of this Privacy Policy and the accompanying Terms of Use.

SCHEDULE I

Indicative List of Information by Nature of Service

End-Users Registering for an Account on the Website or ‘Ferteve’ Mobile Application:

End-Users creating an account on the Website or ‘Ferteve’ mobile application are required to provide information such as their [name, mobile number, email address], and any additional information requested on the End-User registration page. This information is collected to facilitate the creation of an account that allows End-Users to book appointments and store other health-related information.

For each Practitioner listed on https://ferteve.in, there may be a “show number” option. By selecting this option, End-Users initiate a call through a telephony service provided by Ferteve, and the records of such calls are stored on Ferteve’s servers. The call will include an IVR message indicating that the call is being recorded and will request consent for such recording. These recordings are handled in accordance with the Privacy Policy. If the End-User does not consent to the recording, Ferteve reserves the right to withhold the Services for which such Personal Information is required. The recordings will be processed strictly in accordance with the terms of the Privacy Policy.

End-Users Using the Website without Registering for an Account (i.e., ‘Guest’ End-Users):

End-Users can use the Website without creating an account; however, to book an appointment, they may be required to provide certain information, such as their [mobile number] and any additional information requested at the time of booking. This information is used to confirm the appointment.

As with registered End-Users, ‘Guest’ End-Users may also see the “show number” option for each Practitioner listed on https://ferteve.in. By selecting this option, they initiate a call through a telephony service provided by Ferteve, and the records of such calls are stored on Ferteve’s servers. The call will include an IVR message indicating that the call is being recorded and will request consent for such recording. These recordings are handled in accordance with the Privacy Policy. If the End-User does not consent to the recording, Ferteve reserves the right to withhold the Services for which such Personal Information is required. The recordings will be processed strictly in accordance with the terms of the Privacy Policy.

Practitioners Registering for an Account to Avail of the Free Listing Service:

Practitioners who wish to create an account and avail of the free listing service on the Website or ‘Ferteve’ mobile application must provide information such as their [name, mobile number, email address], and any other information requested on the Practitioner registration page. Ferteve may send email and/or SMS confirmations or other communications to End-Users regarding their bookings, appointments, or other interactions with the Practitioner, where such interactions are facilitated through Ferteve.

Practitioners Availing of the Free Listing Service without Registering for an Account:

Practitioners may avail of the listing service without registering for an account by providing information such as their [name, mobile number, email address], and any additional information requested by Ferteve employees or agents who contact the Practitioner by phone or in person. Ferteve will retain this information until the Practitioner chooses to register for an account. Ferteve may contact the Practitioner periodically to offer registration. After collecting this information, Ferteve will send a confirmation email, verifying the provided details and notifying the Practitioner that they will be listed on the Website. If the Practitioner does not wish to be listed, they should notify Ferteve immediately at info@ferteve.in.

End-Users and Practitioners Using the Consult Platform:

End-Users and Practitioners using the Consult platform may be required to create an account and provide information such as their [name, mobile number, email address], and any other information requested during the registration process.

End-Users Availing of Services from Practitioners:
End-Users who receive Services from Practitioners consent to sharing their treatment data, including medical records, with Ferteve for the purpose of ensuring effective delivery of the Services.
